Checkpoint Stop DWAI-Case Dismissed

Client was stopped at a checkpoint and had a Blood Alcohol Concentration of .07 as measured by the Intoxilyzer. Client performed well on coordination tests and looked sober on video. I was not willing to accept a plea to the charge of Driving While Ability Impaired (DWAI) and prepared for a trial in front of a Judge. The case was dismissed on the eve of trial once the District Attorney's Office more closely examined the evidence and the validity of the car stop. This was a case where simply waiting and being willing to go to trial paid off.
